This Sweepstakes is in no way sponsored, endorsed, administered by or associated with Apple, Instagram, Facebook, Twitter, YouTube, LinkedIn or any other social media platform or third party.
The Silvur “New Retirement Normal” Sweepstakes (the “Sweepstakes”) is a rewards program offered by Kindur Services Inc, d/b/a Silvur Services LLC, whereby Silvur Users (as defined below) are eligible to win rewards described in greater detail below. This Sweepstakes is subject to these Silvur New Retirement Normal Official Rules (the “Sweepstakes Rules”). By choosing to participate in this Sweepstakes, you are accepting and agreeing to these Sweepstakes Rules. These Sweepstakes Rules form an agreement between you and Silvur with respect to the Sweepstakes. You should read these Sweepstakes Rules carefully.
Eligibility:
The Sweepstakes is offered and open only to natural persons meeting the following eligibility criteria: (i) age fifty (50) and above as of the date of entry, (ii) are legal residents of the United States of America for the duration of the Sweepstakes, (iii) are Silvur Users (as defined below).
For purposes of this Sweepstakes, a “Silvur User” is an individual who has downloaded the Silvur Mobile Application (the “Silvur App”) and created an account before or during the Sweepstakes Entry Period (defined below). Individuals are limited to one account per person and Silvur reserves the right to disqualify any individual creating multiple Silvur accounts.
Employees, independent contractors, officers, and directors of Kindur Services Inc, Silvur Services LLC and its affiliates and/or subsidiaries (collectively “Silvur” and “Sponsor”), Silvur’s advertising, promotion and fulfillment agencies and legal advisors, and the immediate family members and persons living in the same household of such persons, are not eligible to participate in the Sweepstakes. Void where prohibited by law. Entrants are not required to purchase any products or services offered by Silvur or its partners in order to participate in the Sweepstakes.
Timing/Sponsor:
The Sweepstakes begins July 1, 2020 at 12:01 a.m. Eastern Time (“ET”) and ends December 31, 2020 at 11:59 p.m. ET (“Sweepstakes Entry Period”). Silvur is the official timekeeper for this Sweepstakes. The Sponsor of this Sweepstakes is Kindur Services Inc, d/b/a Silvur Services LLC, 147 W. 24 th Street, 6 th Floor, New York, NY 10011.
How to Enter:
Each action on a Silvur User’s monthly checklist within the Silvur App is worth a designated number of entries in the Sweepstakes (“Monthly Checklist Tasks”). By digitally completing Monthly Checklist Tasks, a “Digital Silvur User” can earn that number of entries in the Sweepstakes. Additionally, from time-to-time, and at Silvur’s sole discretion, Silvur may offer the ability to earn additional entries within the Silvur App by completing certain actions (“Additional Entry Offers“). Any Monthly Checklist Tasks or Additional Entry Offers will specify how many entries it is worth, the actions required to be completed, the time period the Monthly Checklist Offer or Additional Entry Offer is available and any other limitations. A complete list of Monthly Checklist Tasks and Additional Entry Offers can be found here. Digital Silvur Users may check the total number of entries earned within the Silvur App.
Silvur Users may earn entries without completing Monthly Checklist Tasks or Additional Entry Offers by hand-printing their first and last name, complete mailing address, date of birth, email address and phone number on a 3" x 5" piece of paper and mailing it in a separate hand-addressed, stamped envelope with the corresponding task number found on the Monthly Checklist Tasks or Additional Entry Offer hand- printed to the front of the envelope to be mailed to: Silvur “New Retirement Normal” Sweepstakes, P.O. Box 7748, Melville, NY 11775-7748. Limit one (1) mail-in entry per envelope. Silvur Users will receive the number of entries that correspond to the number they printed on the front of the envelope(s). Silvur Users that choose to enter via mail may earn no more entries than a similarly situated Digital Silvur User in any given month. There are some tasks on the Monthly Checklist Tasks that may only be completed once during the Sweepstakes Entry Period and therefore those tasks may not earn entries more than one time. All mail-in entries must be submitted separately and must be complete to be eligible. All mail-in entries must be postmarked by December 31, 2020 and received by January 7, 2021, to be eligible. Mechanically reproduced or automated mail-in entries are not eligible.
No entrant may earn more entries in a month, regardless of method of entry or combination of methods of entry, than is allowed via the exclusive use of one entry method.
Any attempt by any participant to obtain entries by using multiple and/or different identities, forms, email addresses, logins, or any other methods, including entries generated by a script, macro or other automated means, will void that participant’s entries, and that participant may be disqualified at Silvur’s discretion. Multiple participants are not permitted to share the same email address. In the event of a dispute as to any entry, the authorized account holder of the email address used to register will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Conditional winners may be required to show proof of being the authorized account holder to Silvur or forfeit the reward. Entries specifying an invalid, non-working, or inactive email address will be disqualified and ineligible to win. Incomplete, illegible, corrupted, or untimely entries are void and will be disqualified.
By entering this Sweepstakes, you agree that Silvur or its representative may contact you via email, phone, and mail in connection with this Sweepstakes.
Winner Selection:
On or about January 8, 2021, Silvur will select the number of stated winners (below) in a random drawing of all valid entries received for the Sweepstakes Entry Period to award the following rewards:

The potential winners will be contacted using the email address provided with the entry and may be awarded the reward subject to verification of eligibility and compliance with the terms of these Sweepstakes Rules. Failure by potential winners to respond to the initial verification within 48 hours of notification or another time as stated in the notification will result in disqualification and Silvur will select an alternate potential winner in the same manner.
POTENTIAL SWEEPSTAKES WINNERS ARE SUBJECT TO VERIFICATION BY SILVUR. SILVUR’S DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE ADMINISTRATION, OPERATION, SELECTION OF THE WINNERS AND OTHER MATTERS RELATED TO THE SWEEPSTAKES.
Verification of Potential Sweepstakes Winners:
Potential Sweepstakes winners may be required to complete and return an Affidavit of Eligibility, Release of Liability and Publicity Release (where permitted by law) (collectively, the “Affidavit”) by the date specified by Silvur, or an alternate potential Sweepstakes winner may be selected. In the event: (a) potential Sweepstakes winner cannot be reached for whatever reason after a reasonable effort has been exerted or the potential Sweepstakes winner notification or Affidavit is returned as undeliverable; (b) potential Sweepstakes winner declines or cannot accept, receive or use the reward for any reason; (c) of noncompliance with the above or within any of the aforesaid time periods; (d) potential Sweepstakes winner is found to be ineligible to enter the Sweepstakes or receive the reward; (e) potential Sweepstakes winner cannot or does not comply with the Sweepstakes Rules; or (f) potential Sweepstakes winner fails to fulfill the Affidavit-related obligations, the potential Sweepstakes winner shall be disqualified from the Sweepstakes and an alternate potential Sweepstakes winner may be selected, at Silvur’s sole discretion, from among the other eligible entries received. Silvur reserves the right to modify the notification and Affidavit procedures in connection with the selection of alternate potential Sweepstakes winners, if any. No person may receive more than one reward.
For all rewards: Winners will be solely responsible for all taxes and fees associated with the receipt and use of the reward. The reward is awarded as is. Reward is non-transferable and no substitution will be made except as provided herein at the Silvur’s sole discretion. Silvur reserves the right to substitute the listed reward for one of equal or greater value for any reason. Winners are responsible for all taxes and fees associated with reward receipt and/or use. All federal, state, and local tax liabilities, as well as any other costs and expenses not specified herein as being awarded are the sole responsibility of the winners. Winners may be required to complete and return an IRS W-9 form (i.e. Request for Social Security Number and Certification). Reward will be awarded only if the winners fully comply with these Sweepstakes Rules. All rewards amounts listed are in US Dollars (US$).
SILVUR AND ALL OTHER RELEASED PARTIES DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED WITH RESPECT THERETO, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT.
Entry Conditions and Release:
Each entrant agrees to: (a) comply with and be bound by these Sweepstakes Rules and the decisions of Silvur which is binding and final in all matters relating to this Sweepstakes; (b) defend, indemnify, release and hold harmless Silvur, its respective parent, subsidiary, and affiliated companies, and any other person and organization responsible for sponsoring, fulfilling, administering, advertising or promoting the Sweepstakes and all of their respective past and present officers, directors, employees, agents, representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participant’s entry, creation of an entry or submission of an entry, participation in the Sweepstakes, acceptance, possession, attendance at, defect in, delivery of, inability to use, use or misuse of reward (including any travel or activity related thereto) and/or the broadcast, exploitation or use of entry. Winner acknowledges that all rewards are awarded as-is without warranty of any kind.
Publicity:
Except where prohibited or restricted by law, winner’s acceptance of reward constitutes the winner’s agreement and consent for Silvur and any of its designees to use and/or publish winner’s full name, city and state of residence, photographs or other likenesses, pictures, portraits, video, voice, testimonials, biographical information (in whole or in part), and/or statements made by winner regarding the Sweepstakes or Silvur, worldwide and in perpetuity for any and all purposes, including, but not limited to, advertising, trade and/or promotion on behalf of Silvur, in any and all forms of media, now known or hereafter devised, including, but not limited to, print, TV, radio, electronic, cable, World Wide Web, or social media without further limitation, restriction, compensation, notice, review, or approval.
General Terms and Conditions:
WARNING: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL DELIBERATELY TO DAMAGE ANY WEBSITE OR APP ASSOCIATED WITH THIS SWEEPSTAKES OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAW, AND, SHOULD SUCH AN ATTEMPT BE MADE, SILVUR RESERVES THE RIGHT TO PROSECUTE AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Silvur and its subsidiaries, affiliates, divisions, partners, representatives, agents, successors, assigns, employees, officers and directors shall not have any obligation or responsibility, including any responsibility to award any reward to entrants, with regard to: (a) entries that contain inaccurate information or do not comply with or violate the Sweepstakes Rules; (b) entries, reward claims or notifications that are lost, late, incomplete, illegible, unintelligible, damaged or otherwise not received by the intended recipient, in whole or in part, due to computer, human or technical error of any kind; (c) entrants who have committed fraud or deception in entering or participating in the Sweepstakes or claiming the reward; (d) telephone, electronic, hardware, software, network, Internet or computer malfunctions, failures or difficulties; (e) any printing or typographical errors in any materials associated with the Sweepstakes; (f) any inability of the winner to accept the reward for any reason; (g) if a reward cannot be awarded due to delays or interruptions due to Acts of God, natural disasters, pandemic, terrorism, weather or any other similar event beyond Silvur’s reasonable control; or (h) any damages, injuries or losses of any kind caused by any reward or resulting from awarding, acceptance, possession, use, misuse, loss or misdirection of any reward or resulting from participating in this Sweepstakes or any promotion or reward related activities. Silvur reserves the right, in its sole discretion, to disqualify any individual it finds to be (a) tampering with the entry process or the operation of the Sweepstakes, or with any website or app promoting the Sweepstakes; (b) acting in violation of the Sweepstakes Rules; or (c) entering or attempting to enter the Sweepstakes multiple times through the use of multiple email addresses or the use of any robotic or automated devices to submit entries. If Silvur determines, in its sole discretion, that technical difficulties or unforeseen events compromise the integrity or viability of the Sweepstakes, Silvur reserves the right to void the entries at issue, and/or terminate the relevant portion of the Sweepstakes, including the entire Sweepstakes, and/or modify the Sweepstakes and/or award the rewards from all eligible entries received as of the termination date. Each entrant acknowledges and agrees that this Sweepstakes is not sponsored, endorsed or administered by, or associated with, any of the social media or other channels through which this Sweepstakes is promoted or provided.
Disputes and Governing Law:
Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any reward awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate federal or state court located in New York, New York; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Sweepstakes Rules, or the rights and obligations of the entrant and Silvur in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law or conflict of law rules (whether of the State of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York.

Visit silvur.com and click on the “Winners” link towards the bottom of the page. Winners will be announced publicly by January 31, 2021.
